TOKYO (AP) ? Japan's economy shrank 2.3 percent in the fourth quarter as manufacturers were battered by the strong yen, weak export demand amid the European debt crisis and flooding in Thailand.

A drop in public investment during the quarter, due largely to political bickering delaying parliamentary approval for a 12 trillion yen ($156 billion) extra budget for tsunami reconstruction, also contributed to the year-on-year decline reported Monday.

The world's No. 3 economy should get a boost once that rebuilding money kicks in, but the outlook for the country's vital exporters remains unclear, said Masayuki Kichikawa, chief Japan economist at Bank of America Merrill Lynch.

"This should be viewed as temporary setback," Kichikawa said. "To what extent will the European crisis continue to affect overseas demand ? that is the big question."

Japan's major manufacturers, such as Sony Corp. to Honda Motor Co., were hit badly during the fourth quarter by a drop in export demand and flooding in Thailand, a regional factory and supply base, which disrupted their production.

Those problems arose just as many exporters appeared to have recovered from the March 11 earthquake and tsunami, which interrupted their manufacturing at home.

Japan last month reported its first trade deficit since 1980, reflecting broader changes in its economy as manufacturers shift production overseas to escape the strong yen and be closer to their markets. But the Thai flooding underlined that basing production overseas also has risks.

The drop in gross domestic product was worse than expected. Economists polled by Kyodo News agency projected a 1.4 percent decline.

Compared to the previous quarter, October-December GDP fell 0.6 percent, the Cabinet Office said. That comes after 1.7 percent increase in the July-September quarter, reflecting some recovery after the tsunami disaster.

Domestic private consumption, which accounts for over half the economy, edged up 0.3 percent from the previous quarter, the data showed.

Corporate capital investment rose 1.9 percent, while private housing investment fell 0.8 percent and public investment declined 2.5 percent.

Along the tsunami-battered coast, most of the debris has been cleared away, but rebuilding has yet to begin in many towns and communities as local leaders finalize reconstruction plans. Reconstruction is expected to stimulate economic growth, although export demand still appears weak.

"The growth rate will turn positive and stay positive this year because reconstruction demand will continue to push up GDP," said Kichikawa. "But the pace of growth will depend on whether the decline in exports will stabilize."

Economy and fiscal policy minister Motohisa Furukawa said in a statement that exports and production increased in December in a "rebound to the impact of flooding in Thailand."

"If we take into account these factors and look at the overall economic situation, we can say that upward movement is continuing," he said.

Furukawa also said that the U.S. economy is moderately recovering and global business sentiment is improving.

"We expect steady increase of exports amid moderate improvement of the global economy," he said. "However, we need to be fully aware of the downside risk."

For all of 2011, Japan's economy contracted 0.9 percent from 2010, when GDP grew a robust 4.4 percent. In 2009, the economy shrank 5.5 percent in the wake of the global financial crisis.

Many of us who are married or in a committed relationship look to Valentine?s Day as a special time once a year to profess our love, our closeness, the intimacy that we share with that significant other in our lives.

Franciscan Daniel P. Horan, OFM, helps us wrestle with these issues, drawing on St. Francis? spirituality, in the newly released Dating God: Live and Love in the Way of St. Francis.

In an interview I did with the friar in the Franciscan Media offices last month, Brother Dan, who has taught at Siena College, has led retreats with young adults and who writes for the blog ?Dating God: Franciscan Spirituality for the 21^st Century,? stressed that the desire, the uncertainty,?the passion and time set aside with those most important to us should resemble our relationship with God.

?One of the things that I want to stress from the book,? he says, ?is that we become so focused on our relationship with God as different from that of other people, whether it?s our spouse, our friends, our co-workers.

?But,? Dan says, ?our relationship with God is a human relationship like it is with anything else.?

He pointed to different images people use to understand their relationship with God: parent, brother, guide on a journey or, as some Christian mystics have suggested, lover. But he stressed that any image we use for God, who is so different from us, ?will be helpful for some people and not for others.?

But while many Christians speak about loving God, oftentimes that love seems devoid of connection, of real relation to our lives, of intimacy, of the impossibility of anything but difference between us and the divine.

The image of dating for Brother Dan is one way to break through that. ?This will allow somebody to think about God as somebody we can relate to, not unlike somebody we are dating.

?And in good relationships, dating relationships, when you?re getting to know somebody, we?re very excited and energetic about that,? he says. ?The same is true about God.?

But it becomes ?unnerving ? to pause and think about somebody who knows all of the deep, dark secrets of our hearts and at the same time knows the joys of our lives.

?So what this book I hope does,? he says, ?is get people to a good glimpse of what Francis and Clare of Assisi and their followers offer us in way of inspiration, wisdom and insight in helping us to understand our relationship to God in a contemporary way in the 21^st century.?

PEBBLE BEACH, Calif. (AP) ? Charlie Wi is pleasant by nature, so he was not likely to be insulted when someone asked him if it felt like an out-of-body experience to see his name atop the leaderboard through two rounds of the Pebble Beach National Pro-Am.

He escaped most of the rain Friday at Pebble Beach, holed out a wedge for eagle from the 13th fairway and escaped with bogey on his final hole for a 3-under 69 that gave him a three-shot lead over Dustin Johnson.

"It's my seventh year on the PGA Tour," Wi said. "I'm doing something good to be here for that long."

The leaderboard was filled with possibilities going into Saturday, when everyone completes the three-course rotation, and it was easy to overlook the guy at the top ? especially because Wi has never won on tour.

Johnson is a two-time Pebble Beach champion in the last three years, and a rare lapse in his short game forced him to settle for a 72 at Spyglass Hill. Another shot behind were a pair of multiple major champions, Vijay Singh and Padraig Harrington. Right behind was Phil Mickelson, a three-time winner at Pebble, a four-time major champion.

And still in the mix: Tiger Woods.

Woods took 33 putts at Monterey Peninsula and had to settle for a 68, leaving him six shots behind.

"I've going to have to shoot a low one tomorrow," Woods said.

Wi and Woods have a history, even if Woods might not remember. They played junior golf together in Southern California in the 1980s, and one tournament stands out for Wi.

"I knew he was a fierce competitor, even when we were younger," Wi said. "I remember playing with him when I was 13 and he was 9, and we were playing together. There's a golf course in Long Beach called El Dorado. The ninth hole is a really long par 3. I didn't know what he did with his tee shot, but I remember he had 70 yards left, and he lipped it out and got so mad.

"I said, 'What's wrong?' I thought it was a great shot," Wi said. "He said, 'I was trying to hole that.' I said, 'Oh, come on.' And that always stuck with me ? 9 years old at El Dorado."

Did he beat Woods that day?

"He was 9," Wi said with mock indignation. "Yes. I was outdriving him back then."

Woods went on to six consecutive USGA titles, 14 majors, 83 wins worldwide, No. 1 in the world longer than anyone. Wi wound up at Cal and then traveled the world ? Asia, Europe, anywhere he could find to play. He's on the slow road, but happy with the progress.

He has made over $1 million his last five seasons on the PGA Tour, enough to comfortably keep his card, but not enough to attract much attention except for about five years ago when people jokingly made reference to Michelle Wie.

Wi turned 40 at the start of the year, and he found a certain peace about his game, and about his future. He always knew he was good enough to play on the PGA Tour, but the doubts began to creep in whenever he came close to winning.

He feels he turned the corner at Colonial last year, when he had a one-shot lead going into the final round and lost by one shot on the final hole to David Toms.

"It was the first time where I had the lead Saturday night. I really enjoyed that," Wi said. "I wrote down in my notebook, 'Being in the lead is fun.' I think I started embracing it instead of being scared."

Looking to the back of the room at a local television reporter, he added, "I know you asked me, 'Is it an out-of-body experience?' No. I've been there, and it's better than being 30th, that's for sure."

The question is where he goes from there.

Wi was at 12-under 130 and headed for Spyglass Hill, which has played slightly tougher than the other two courses. Harrington, whose 66 was the low score Friday, and Singh also go to Spyglass.

The main event, typical for Saturday of this event, is at Pebble Beach.

That's where the celebrities will be, and CBS Sports is likely to spend most of its TV time on the actors and comedians. In their midst will be Mickelson and Woods, though on opposite sides of the course.

Mickelson, in the best of the sunshine Friday, stumbled his way around the Monterey Peninsula. The clouds moved in, a mist turned into a light rain, and Lefty came to life with five birdies for a 65.

"I don't know what happened, but I started to play a lot better and make some birdies," said Mickelson, a three-time winner at Pebble. "In the perfect conditions, I struggled. But to play these golf courses in such great condition either way has been a lot of fun."

He was at 7-under 135, primed to change his West Coast Swing fortunes.

Woods handled the weather fine. He just couldn't handle the greens. Woods started to make a surge with back-to-back birdies early in his round ? one of them a two-putt from 8 feet ? but he lost momentum by missing a 5-foot birdie putt on the par-3 ninth, and by pulling his approach into the gallery on the par-5 10th, leaving himself a tough up-and-down. He settled for par.

"It's very close," said Woods, playing this event for the first time in 10 years. "I got my ball-striking to where I feel very comfortable hitting the shots. I just need to make a couple of putts to get on a roll."

Pebble Beach is where Woods usually plays his best. He had a 63-64 weekend in 1997, when he finished one shot behind Mark O'Meara. Woods also had a 64 in the final round of 2000 to rally from five shots behind.

He has three rounds of 64 or better on the fabled course during the AT&T Pebble Beach National Pro-Am.

"I'm hitting good putts," Woods said. "I'm not displeased with my putting at all. I just didn't hit the ball in the right spots to give myself the right looks. If we were putting smooth greens, it would be a totally different deal."

Despite his emotional abuse -- he dubs his wife (Sarah Goldberg) ''pusillanimous" -- Jimmy is attractive to women. Both Alison, whose odd silences speak volumes, and her friend Helena (Charlotte Parry), an actress who encourages her to leave her tempestuous husband, are drawn to him.

While Look Back has some passing similarities to A Streetcar Named Desire, this is a poor-man's version of the William's masterpiece. It has ample class warfare and sexual heat. What it doesn't have are the layered themes or poetic insights that made Streetcar so compelling and enduring.

Still, audiences will appreciate the powerful performances: As Jimmy, Rhys is a lithe tiger, waiting to pounce. He's amazing to watch, while Goldberg beautifully captures Alison's frustrations and longings. The scene where she chops vegetables, underscoring her domestic woes, is masterful. Similarly, Driver and Parry, drawn to and repelled by the Porters, are terrific.

Sam Gold has skillfully staged Look Back In Anger against a black wall; the space is dirty and cramped -- the lone wail of a trumpet punctuates the cycle of despair. The director has trimmed elements of the original play, zooming in on the dysfunctional love relationships. However dated, it retains its power to disturb, bolstered by an excellent cast.

UBS warns of poor Q1 as investment bank struggles (Reuters)

ZURICH (Reuters) ? Swiss bank UBS (UBSN.VX) predicted further weakness in investment banking after a restructuring of the business failed to prevent an earnings hit from the euro zone debt crisis and worries about the global economy.

"Traditional improvements in first-quarter activity levels and trading volumes may fail to materialize fully, which would weigh on overall results for the coming quarter, most notably in the investment bank," UBS said on Tuesday.

The bank said fourth-quarter net profit shrank to 393 million Swiss francs from 1.66 billion francs in the 2010 period and compared with a forecast for 737 million in a Reuters poll.

Investment banks had a torrid time last year as trading and advisory income was hammered as clients pulled back from markets due to the euro zone debt crisis, and stopped doing deals. The outlook is set to remain tough as tougher regulations and economic slowdown bite.

U.S. rivals including Goldman Sachs (GS.N) and JPMorgan (JPM.N) posted weak fourth quarter income, and Deutsche Bank (DBKGn.DE) also fell to a fourth quarter loss due to a slump in bond trading.

UBS, which announced in November it would scale back its investment bank business to focus on its flagship private bank, said it had cut risky assets by 20 billion Swiss francs in the fourth quarter with "no significant impact on profitability."

Kepler Capital Markets analyst Dirk Becker welcomed the reduction in risky assets but said there were still questions over the future of the investment bank.

"Revenues have recovered from the really poor Q3 levels, but are still too low to feed a division with still over 17,000 employees," he said.

"The downsizing plans of the management will reduce this revenue base further and make it impossible to achieve satisfactory returns for this division, which will still consume the largest part of the capital."

Shares in UBS trimmed initial losses to be down 0.7 percent in midday trade.

UBS said it saw a few "bright spots" in the performance of its investment bank, which was hit by a $2 billion rogue trader scandal uncovered in September but pared its pretax loss to 256 million from a loss of 650 million the previous quarter.

UBS said it was making progress on delivering on plans to cut total headcount by almost 4,000, with total staff down 1,101 in the quarter to 64,820 at the end of 2011, but said it would have to slash more costs if market conditions worsen.

"The investment bank clearly did better than feared with better than expected revenue streams, however, wealth management clearly suffered from weak client activity," said Vontobel analyst Teresa Nielsen.

Inflows at the UBS flagship private banking arm slipped to 3.1 billion Swiss francs ($3.4 billion) in the fourth quarter from 3.8 billion in the previous quarter, while the gross margin on invested assets fell 6 basis points to 91 basis points.

UBS financial head Tom Naratil said uncertainty in the eurozone was doing more to dampen activity by wealthy clients than the trading scandal: "The trading incident is not something clients are talking to us about today."

UBS stressed its eurozone exposure was relatively low, in comparison to Deutsche Bank which recently posted a fourth-quarter loss amid one-off charges such as Greek debt writedowns into the quarter.

The affair surrounding former UBS trader Kweku Adoboli will linger as he is set to stand trial in September after pleading not guilty to trades the Swiss bank says were unauthorized.

UBS said investment banking head Carsten Kengeter would voluntarily forgo a bonus for 2011 after the scandal, while total bonuses for the bank will fall 40 percent and 60 percent in the investment bank.

Naratil said UBS would issue loss-absorbing capital to meet tough new Swiss capital rules fairly quickly, but that it still prefers non-dilutive forms of capital such as write-down debt over contingent convertible bonds, or CoCos.

He told a news conference the bank was initially considering issuing around $1 billion in dollar denominated capital.

Researchers from the University of Southampton are leading an international research exchange that aims to develop a greater understanding of anxiety disorders and develop more effective treatments for patients.

The joint European and South African Research Network in Anxiety Disorders (EUSARNAD) study involves 13 centres of excellence for research into anxiety disorders and builds on the Anxiety Disorders Research Network (ADRN).

The research programme aims to strengthen existing links and develop collaborative work with the University of Cape Town, and will allow South African researchers first-hand experience of certain research methodologies in European centres. Moreover, it will help European investigators to develop greater understanding of the origin of anxiety disorders and problems in their management within an emerging country, and enhance the relevance of translational research activity to other developing societies.

David Baldwin, Professor of Psychiatry at the University of Southampton and Coordinator of the EUSARNAD study, says: "Anxiety disorders are common, distressing and impairing conditions but many people remain undiagnosed and the standard of care received is usually sub-optimal. Although advances in genetics, neuroscience, pharmacology and psychology research have all deepened our understanding of anxiety disorders, on an individual basis it remains difficult to predict who will become troubled by symptoms and difficult to make treatment decisions which would result in better clinical outcomes for the patient. An international collaborative network for sharing clinical databases, refining research methodologies, and developing and evaluating innovative treatments, which is what the EUSARNAD study aims to do, will give us a greater understanding of the causes of anxiety disorders and be able to develop and improve delivery of better treatments."

During the two-year study, individual exchange researchers will be affiliated to existing clinical research teams in each of the participating institutions. They will have access to the knowledge and expertise at each centre. They may also be able to attend postgraduate training programmes within the host institutions.

The first exchange researcher, Sonja Pasche, a clinical psychologist, joined the University of Southampton last October. She says: "Being based at Southampton has provided me with fantastic exposure to new ideas and clinical practice, and has allowed me to explore the overlap between anxiety and substance use disorders."

This is the first time such a research exchange has been undertaken. South Africa offers many opportunities to gain new and additional insights into the mechanisms that underlie and maintain anxiety disorders.

Professor Baldwin comments: "Collaboration with the University of Cape Town in South Africa allows us access to unique genetic populations; a pattern of exposure to infectious agents which differs to that in Europe; and access to a range of clinical groups that allow important questions about anxiety to be explored in more detail than would be possible within Europe. The scheme could help harmonise research and clinical databases, improve research methodologies, refine prediction of clinical outcome and encourage evaluation of innovative interventions."

Defendant may have forgotten password

A Colorado woman, recently ordered by a judge to turn over her password to decrypt her hard drive, may not remember what that password is.

Last month, a federal judge ruled that Ramona Fricosu had until Feb. 21 to comply with his order to turn over her password to the decrypted hard drive so that police can view the files on it. U.S. District Court Judge Robert Blackburn previously ruled that Fricosu's defense ? the Fifth Amendment's right against self-incrimination ? did not apply in the case, in which Fricosu is charged with bank fraud, wire fraud and money laundering tied to a mortgage scam.

?It?s very possible to forget passwords,? Fricosu's attorney, Philip Dubois, told Wired Monday. ?It?s not clear to me she was the one who set up the encryption on this drive. I don?t know if she will be able to decrypt it.?

If she can't remember the password, ?The government will probably say you need to put her in jail until she breaks down and does what she is ordered to do,? Dubois said. ?That will create a question of fact for the judge to resolve. If she?s unable to decrypt the disc, the court cannot hold her in contempt.?

Dubois plans to petition the U.S. Court of Appeals on the judge's ruling. The Electronic Frontier Foundation has also weighed in on the case with an amicus brief on behalf of the defendant, saying the judge's order is a violation of the Fifth Amendment. In addition, the EFF says, the government did not specify what it is looking for on Fricosu's laptop, making it seem like an "evidence-fishing trip."

The prosecutor in the case, Patricia Davies, told Wired Fricosu has not indicated in any court documents that she forgot the password.

?She has not taken that position in court,? Davis said. ?When she does, we?ll figure it out.?

ScienceDaily (Feb. 6, 2012) ? When Hiroaki Matsunami, PhD, associate professor at Duke University, set out to study a chemical in male mouse urine called MTMT that attracts female mice, he didn't think he would stumble into a new field of study.

But the research has led scientists at Duke University Medical Center and the University of Albany to the discovery that it's the copper in our bodies that makes mammals recoil from sulfurous chemical smells.

Working with Eric Block, PhD, the Carla Rizzo Delray Distinguished Professor of Chemistry at the University of Albany, the team looked at reasons why mammals, including people, can detect even trace amounts of sulfur-containing substances, like MTMT.

"While we were doing our experiments, on even very dilute specimens of MTMT, our neighbors on the lab hallway complained," Matsunami said with a laugh. He is an associate professor in the Duke Department of Molecular Genetics and Microbiology and the Department of Neurobiology.

The Duke laboratory ran a high-throughput test of several hundred mammalian odor receptors, and found that one receptor that bound copper ions resulted in superior detection of even trace amounts of sulfur.

Underarm odors from bacteria, skunk spray, volcanic gases and odorized natural gas (for leak detection) are examples of sulfurous substances.

The work was published in the Proceedings of the National Academy of Sciences online the week of Feb. 6.

"We learned that copper was the metal that allowed for detection of all the sulfur-containing compounds we tested, and it was Eric Block's idea that metal ions must be involved," Matsunami said. "Further, I see no reason why the mouse receptor activity would be different from human receptors, because we have the same kind of olfactory receptors."

Block and colleagues created several dozen sulfur-containing compounds for testing.

The odor impact of the sulfur-containing molecule MTMT can be attenuated by manipulating the copper concentration in the nasal mucus. The team did experiments using a chemical that binds to copper in the mouse nose, so that copper wasn't available to the receptors, and the mice didn't detect the MTMT, Matsunami said.

"This study establishes for the first time the key role of a metal, namely copper, in the activity of an olfactory receptor," Eric Block said. "What's also exciting is that, because olfactory receptors are transmembrane G protein-coupled receptors (GPCRs) of the same type as receptors for drugs, our discovery suggests a possibility that some drug-receptor responses may also be enhanced in the presence of copper or other metal ions."

Other authors include Siji Thomas and Shaozhong Zhang, of the University of Albany Department of Chemistry; Timothy Connelly, Qiuyi Chi and Minghong Ma of the Department of Neurobiology, University of Pennsylvania School of Medicine; and Xufang Duan, Zhen Li, Lifang Wu, Guo-Qiang Chen and Hanyi Zhuang, all of the Ruijin Hospital in China. The senior authors on the paper were Dr. Matsunami and Dr. Zhuang, formerly of Duke, who is also with the Institute of Health Sciences, Shanghai Institutes for Biological Sciences of Chinese Academy of Sciences, Shanghai Jiao Tong University School of Medicine, Shanghai.

Short-sales. These are pre-foreclosed properties that are typically being sold at a lower price so that the seller doesnt have to foreclose. Designed to create an ideal situation for all involved parties, short-sales can offer great deals for the seller, buyer and bank.

If you are looking into a short-sale property, be sure you are pre-approved for a loan, cautions Rand. Also, make sure to have a solid home inspection done.

Auctions. An auctioned home is one of the riskier types of foreclosed property purchases, as he buyer often has a limited window of time to view the property, and no opportunity for a proper home inspection.

These as-is properties can be a great deal for the seasoned real estate investor who knows what to look for. If youre new to the field, purchasing a foreclosed home at an auction could be devastating financially when major unseen problems arise, warns Rand.

LAS VEGAS (AP) ? Republican presidential candidate Newt Gingrich, defeated in Florida by a wide margin, is challenging rules in the state that handed all 50 delegates to Mitt Romney.

The Gingrich campaign planned to send a letter to the Republican Party of Florida asking that it "enforce existing rules" that say delegates should be awarded proportionally, a campaign spokesman said Thursday.

It was the second time the Gingrich campaign complained about primary rules after suffering a setback. When the campaign failed to meet the requirements of getting on the primary ballot in Virginia, it went to court with other candidates to have the requirements annulled. A federal judge declined to do so.

The move came as Gingrich lost the endorsement of real estate tycoon Donald Trump, which his campaign had thought was in the bag. Trump threw his support behind Romney on Thursday.

Earlier in the day, Gingrich took a jab at Romney for saying he is focused on helping the middle class because poor people have a safety net.

"I really believe that we should care about the very poor, unlike Gov. Romney," Gingrich said.

Gingrich said both Romney and Democratic President Barack Obama think poverty can be solved with a safety net.

"What the poor need is a trampoline so they can spring up," he said. "So I want to replace a safety net with a trampoline."

Romney spokeswoman Amanda Henneberg responded that Gingrich was joining Democrats in "distorting Mitt Romney's comments."

Gingrich campaigned in Nevada as the state prepared for Saturday's caucuses. He toured a Las Vegas forklift manufacturing plant and held a roundtable with Hispanic leaders before ducking into a fundraiser.

Romney is favored in the state, which he won when he sought the GOP nomination in 2008.

Gingrich campaign officials see their second-place finish in Florida as translating into 16 delegates if they were awarded proportionally.

A statement from Lenny Curry, chairman of the Republican Party of Florida, said the 38 members of the party's executive board unanimously passed a rule last year authorizing the change.

"It is a shame when the loser of a contest agrees to the rules before and then cries foul after losing," Curry said.

The United States imposed the harshest sanctions so far on Iran when President Barack Obama on December 31 signed into law new sanctions on transactions involving Iran's central bank.

The European Union last week imposed a ban on the import, purchase or transport of Iranian oil.

"Energy sanctions against Iran will only cause world oil prices to rise and hurt the global economic recovery. That is why I think China is not supportive of further sanctions on Iran."

Millions of Ukrainians have uploaded and downloaded music, movies, and software from the website since it was founded in 2009.

Personalized medicine offers the potential to transform the delivery of healthcare to patients. Healthcare will evolve from a reactive "one-size-fits-all" system towards a system of predictive, preventive, and precision care. Areas in which personalized approaches are particularly promising include oncology, cardiovascular diseases, neurodegenerative diseases, psychiatric disorders, diabetes and obesity, arthritis, pain, and Alzheimer's disease. In all of these fields, and others, a personalized molecular medicine approach is expected to lead to better health outcomes, improved treatments, and reduction in toxicity due to variable or adverse drug responses. For example, cancer patients would be screened to identify those for whom chemotherapy would be ineffective. In addition to saving on the costs of expensive drug treatments, this personalized treatment would prevent a great deal of suffering, while identifying and initiating earlier treatments that would be more effective.

Next Friday, February 10, the Stanford Technology Law Review is holding its annual symposium, and this year's topic is an important one:?First Amendment Challenges in the Digital Age. Of the three panels, one is devoted to privacy and another to copyright. The third is devoted to a long, ambitious law review article ... written by me. The panel participants joining me to discuss the article are two of the nation's great free speech scholars--Harvard's Yochai Benkler and the University of Virginia's Lillian BeVier. The article is called First Amendment Architecture. In it, I argue that the First Amendment plays an important role in ensuring adequate physical and digital spaces for speech, and that this role is not some exceptional outgrowth of First Amendment doctrine but is central to understanding what the First Amendment "means." While I submitted the paper for publication in February 2011, the subsequent events of the Arab Spring, the Occupy Movement, and the fight over SOPA/PIPA have all highlighted the significance to democratic speech?of open physical and digital spaces.

I am using the occasion of this symposium panel to blog about First Amendment Architecture. Law review "articles" generally add up to 30,000 words, or 60 pages, and have hundreds of footnotes and use semi-colons; this article is definitely a creature of that genre. My language in the piece is simple?I think, but the blog genre is better for discussing the same arguments in bite-sized, digestible pieces. Several people have already blogged about my article briefly (saying nice things even), such as law professors Tim Wu (calling it "important work") and Susan Crawford (calling it "a terrific article"), as well MSNBC host Dylan Ratigan (saying it addresses "important ... First Amendment questions")?.

This first post is more about the amazing panel and about why I chose to research and write this article. The next pieces will present the article's arguments more fully.

First, the amazing panel.?I am so nerd-excited that two of the nation's leading First Amendment scholars will critique and respond to the arguments I have been marking. ?Harvard's Yochai Benkler may agree with me at points and Lillian BeVier of UVA will likely disagree with me at many points. For those unfamiliar with Benkler, Larry Lessig calls him "the leading intellectual of the information age," and he is a leading free speech theorist. He was also my professor and paper advisor when I was in law school. (That had a major effect on the trajectory of my life.) He is also one of the kindest people I've ever met. BeVier is also a giant in First Amendment scholarship, having made important contributions to constitutional law on impenetrable topics ranging from the state action doctrine to the public forum doctrine. I have learned a lot from her work. It's an honor that she will take the time out of her schedule to disagree with me on the ?panel. In a phone call, she has kindly called my article "um... ambitious." I'll take that.

Second, why I wrote this paper.?My mom knows that I have led something of a double life over the past few years, with one foot in public policy and one in academia. (I now keep toes in policy and the think tank world.) But a lot of people from one world don't realize I have worked in the other. For example, last week, I had lunch with technology lawyers in Washington, DC. These lawyers knew me from my work to help advance network neutrality and to help defeat the Stop Online Piracy Act (SOPA), etc. These lawyers asked me if I had ever heard of the Space and Cyberlaw Program at the University of Nebraska. I had indeed heard of it--while a law professor for a few years, I was a co-founder of the program and helped build it into a program educating many of the US Air Force's cyber-lawyers and educating some of DC's rising legal stars in tech. Similarly, years ago, while at Nebraska, on the day the DC Circuit struck down the FCC's Comcast/BitTorrent order in April 2010, several of the other law professors on my faculty noticed the headlines on the front pages of the WashingtonPost.com, the NYTimes.com, and even the Huffington Post, which had run the ominous banner headline "The Day the Internet Lost." While several students offered me condolences on the decision, three of my colleagues on the faculty asked me, "Hey, have you heard about this Internet case everyone is talking about?" I had indeed heard of--I had brought the case before the FCC and argued it (and lost) before the DC Circuit.

I saw the need for this article because of that double life. Much of my work strikes me as pretty unified: as a lawyer, working in several areas, I have thought about how to promote freedom of speech broadly for everyone. To me, freedom of speech and debate are necessary inputs in solving any of our nation's problems, from homelessness and economic inequality to banking, the environment, and national security. Freedom of speech is what Larry Lessig would call a "root" issue; working on free speech is striking at a root issue.

Thinking about free speech brought me to media regulation, as Americans access so much of their political and cultural speech through mass media. That led me to work on the FCC's media ownership rules beginning in 2005 to fight media consolidation, working with those at Georgetown's IPR, Media Access Project, Free Press and others. I then turned to the Internet as the core speech tool of our age, and in 2006 worked on Congress's first network neutrality bills, addressing an issue that people often called the foremost First Amendment issue of our time. It was through this work that I worked with Stanford's Barbara van Schewick and Columbia's Tim Wu, among others in academia. I also worked on unlicensed spectrum and privacy and copyright, including recently on SOPA, and wrote about national security and civil liberties, and global free speech matters. All of these were unified by free speech concerns.

But the policy arguments were not enough ... ?we needed to articulate a compelling constitutional framework. The media, telecom, and studio giants, and many speech scholars, assumed and advanced First Amendment framework that would render unconstitutional?media ownership caps, network neutrality rules, and many other rules designed to promote individuals' access to spaces to speak to receive diverse sources of speech.?Just as?Citizens United?privileged the free speech rights of powerful corporations over the speech of average Americans, in my opinion, some common views of the First Amendment privilege giant telecom, cable, and media corporations over average Americans.

That is, even if Congress or the FCC did adopt the pro-free-speech rules or laws for which we advocated, the Supreme Court would be the next hurdle, as suggested by several industry lawyers and even prominent?constitutional scholars. For example, while Harvard Professor Laurence Tribe and I?agreed?on the unconstitutionality of SOPA, we disagreed on the?constitutionality?of network neutrality.

So my scholarship has attempted to articulate a framework for advancing freedom of speech in our time--and my advocacy has worked, in a small way, to advance that same goal. In my scholarship, particularly in a series of three articles (here, here, and in Architecture), I try to build on the important work of C. Edwin Baker, Yochai Benkler, Jerome Barron, Jack Balkin, Owen Fiss, Joshua Cohen, and many many scholars in my generation (Greg Magarian, among others, comes to mind). I have tried to help build a framework that recaptures the First Amendment as a principle to empower all Americans, politically and personally, through access to plentiful, diverse communications spaces.

Architecture is my biggest contribution to that project, a project that many of us are working on from different angles.

So, over the next weeks, I will aim to post a few bite-sized blog pieces setting out its arguments.

Erivedge Approved to Treat Basal Cell Carinoma (HealthDay)

MONDAY, January 30 (HealthDay News) -- Erivedge (vismodegib) has been approved by the U.S. Food and Drug Administration to treat the most common form of skin cancer, basal cell carcinoma, the agency said Monday.

The drug was approved for people for whom surgery or radiation aren't options, and for people with basal cell that has spread to other parts of the body, according to an FDA news release.

Basal cell usually is a slow-growing, painless type of cancer that begins in the top layer of skin, often on areas most exposed to the sun.

Erivedge was evaluated in clinical studies involving 96 people with basal cell carcinoma. The most common side effects included muscle spasms, hair loss, weight loss, nausea, diarrhea, fatigue, distorted taste, loss of appetite and constipation.

The drug was approved with an FDA's label warning that pregnant women who take Erivedge could have babies at greater risk of severe birth defects or death. "Pregnancy status must be verified prior to the start of Erivedge treatment," the agency release advised.

Erivedge is marketed by Genentech, based in San Francisco, Calif.

In dozens of tanks and armored vehicles, Syrian troops stormed rebellious areas near the capital Sunday, shelling neighborhoods that have fallen under the control of army dissidents and clashing with fighters. At least 62 people were killed in violence nationwide, activists and residents said.

The widescale offensive near the capital suggested the regime is worried that military defectors could close in on Damascus, which has remained relatively quiet while most other Syrian cities descended into chaos after the uprising began in March.

The rising bloodshed added urgency to Arab and Western diplomatic efforts to end the 10-month conflict.

The violence has gradually approached the capital. In the past two weeks, army dissidents have become more visible, seizing several suburbs on the eastern edge of Damascus and setting up checkpoints where masked men wearing military attire and wielding assault rifles stop motorists and protect anti-regime protests.

Their presence so close to the capital is astonishing in tightly controlled Syria and suggests the Assad regime may either be losing control or setting up a trap for the fighters before going on the offensive.

Residents of Damascus reported hearing clashes in the nearby suburbs, particularly at night, shattering the city's calm.

"The current battles taking place in and around Damascus may not yet lead to the unraveling of the regime, but the illusion of normalcy that the Assads have sought hard to maintain in the capital since the beginning of the revolution has surely unraveled," said Ammar Abdulhamid, a U.S.-based Syrian dissident.

"Once illusions unravel, reality soon follows," he wrote in his blog Sunday.

Soldiers riding some 50 tanks and dozens of armored vehicles stormed a belt of suburbs and villages on the eastern outskirts of Damascus known as al-Ghouta Sunday, a predominantly Sunni Muslim agricultural area where large anti-regime protests have been held.

Some of the fighting on Sunday was less than three miles (four kilometers) from Damascus, in Ein Tarma, making it the closest yet to the capital.

"There are heavy clashes going on in all of the Damascus suburbs," said Rami Abdul-Rahman, director of the British-based Syrian Observatory for Human Rights, who relies on a network of activists on the ground. "Troops were able to enter some areas but are still facing stiff resistance in others."

The fighting using mortars and machine guns sent entire families fleeing, some of them on foot carrying bags of belongings, to the capital.

"The shelling and bullets have not stopped since yesterday," said a man who left his home in Ein Tarma with his family Sunday. "It's terrifying, there's no electricity or water, it's a real war," he said by telephone on condition of anonymity, for fear of reprisals.

The uprising against Assad, which began with largely peaceful demonstrations, has grown increasingly militarized recently as more frustrated protesters and army defectors have taken up arms.

In a bid to stamp out resistance in the capital's outskirts, the military has responded with a withering assault on a string of suburbs, leading to a spike in violence that has killed at least 150 people since Thursday.

The United Nations says at least 5,400 people have been killed in the 10 months of violence.

The U.N. is holding talks on a new resolution on Syria and next week will discuss an Arab League peace plan aimed at ending the crisis. But the initiatives face two major obstacles: Damascus' rejection of an Arab plan that it says impinges on its sovereignty, and Russia's willingness to use its U.N. Security Council veto to protect Syria from sanctions.

Arab League Secretary-General Nabil Elaraby told reporters Sunday in Egypt that contacts were under way with China and Russia.

"I hope that their stand will be adjusted in line with the final drafting of the draft resolution," he told reporters before leaving for New York with Qatari Prime Minister Hamad bin Jassim.

The two will seek U.N. support for the latest Arab plan to end Syria's crisis. The plan calls for a two-month transition to a unity government, with Assad giving his vice president full powers to work with the proposed government.

Because of the escalating violence, the Arab League on Saturday halted the work of its observer mission in Syria at least until the League's council can meet. Arab foreign ministers were to meet Sunday in Cairo to discuss the Syrian crisis in light of the suspension of the observers' work and Damascus' refusal to agree to the transition timetable, the League said.

U.N. chief Ban Ki-moon said he was "concerned" about the League's decision to suspend its monitoring mission and called on Assad to "immediately stop the bloodshed." He spoke Sunday at an African Union summit in Addis Ababa.

While the international community scrambles to find a resolution to the crisis, the violence on the ground in Syria has continued unabated.

The Syrian Observatory for Human Rights said at least 27 civilians were killed Sunday in Syria, most of them in fighting in the Damascus suburbs and in the central city of Homs, a hotbed of anti-regime protests. Twenty-six soldiers and nine defectors were also killed, it said. The soldiers were killed in ambushes that targeted military vehicles near the capital and in the northern province of Idlib.

The Local Coordination Committees' activist network said 50 people were killed Sunday, including 13 who were killed in the suburbs of the capital and two defectors. That count excluded soldiers killed Sunday.

The differing counts could not be reconciled, and the reports could not be independently confirmed. Syrian authorities keep tight control on the media and have banned many foreign journalists from entering the country.

Syria's state-run news agency said "terrorists" detonated a roadside bomb by remote control near a bus carrying soldiers in the Damascus suburb of Sahnaya, killing six soldiers and wounding six others. Among those killed in the attack some 12 miles (20 kilometers) south of the capital were two first lieutenants, SANA said.

In Irbil, a Kurdish city in northern Iraq, about 200 members of Syria's Kurdish parties were holding two days of meetings to explore ways of supporting efforts to topple Assad.

Abdul-Baqi Youssef, a member of the Syrian Kurdish Union Party, said representatives of 11 Kurdish parties formed the Syrian Kurdish National Council that will coordinate anti-government activities with Syria's opposition.

Kurds make up 15 percent of Syria's 23 million people and have long complained of discrimination.

If the Fed does resort to QE3 to stimulate growth, investors "don't want to be caught flat-footed and be out of risky assets," Kraus said.

Consumer product company Procter & Gamble dipped 0.8 percent to $64.30.

Ford Motor Co (F.N) shares fell 4.2 percent to $12.21 after the carmaker reported a lower-than-expected fourth-quarter profit on higher commodity costs and losses in Europe and Asia.

Network equipment makers Juniper Networks Inc (JNPR.N) and Riverbed Technologies Inc (RVBD.O) gave first-quarter outlooks after the close Thursday that were below expectations. Juniper fell 3 percent to $21.69 while Riverbed slid 18.3 percent to $24.45.

According to Thomson Reuters data, 59 percent of 184 S&P 500 companies reporting earnings through Friday have topped analysts' estimates, below the beat rate of about 70 percent seen at this stage of earnings season in recent quarters.

College presidents wary of Obama cost-control plan (AP)

WASHINGTON ? Illinois State University President Al Bowman says President Barack Obama's proposal to tie federal support to tuition controls is a product of "fuzzy math." His counterpart at the University of Washington calls it little more than "political theater."

Obama's plan to force colleges and universities to contain tuition or face losing federal dollars, spelled out Friday during a speech at the University of Michigan, concerned education leaders worried about the threat of government overreach. From presidents of public universities frustrated with ever-increasing state budget cuts affecting their schools' bottom line, it brought some particularly sharp words.

The reality, says Bowman, is that deficits in many public schools can't be easily overcome with simple modifications. He says he was happy to hear Obama call for state-level support of public universities, but given the decreases in state aid, tying federal support to tuition prices is a product of fuzzy math.

Illinois has decreased public support for higher education by about a third over the past decade when adjusted for inflation. Illinois State University, with 21,000 students, has raised tuition almost 47 percent since 2007 ? from $6,150 a year for an in-state undergraduate student to $9,030.

"Most people, including the president, assume if universities were simply more efficient they would be able to operate with much smaller state subsidies, and I believe there are certainly efficiency gains that can be realized," Bowman said. "But they pale in comparison to the loss in state support."

Bowman said the undergraduate experience can be made cheaper, but there are trade-offs.

"You could hire mostly part-time, adjunct faculty. You could teach in much larger lecture halls, but the things that would allow you achieve the greatest levels of efficiency would dilute the product and would make it something I wouldn't be willing to be part of," he said.

University of Washington President Mike Young said Obama showed he did not understand how the budgets of public universities work.

Young said the total cost to educate college students in Washington state, which is paid for by both tuition and state government dollars, has actually gone down because of efficiencies on campus. While universities are tightening costs, the state is cutting their subsidies and authorizing tuition increases to make up for the loss.

"They really should know better," Young said. "This really is political theater of the worst sort."

Obama's plan must be approved by Congress, where it could face a tough road to passage among gridlocked lawmakers.

Earlier in the week, during his State of the Union address, Obama described meeting with university presidents who told of ways some universities were curtailing costs through technology and redesigning courses to help students finish more quickly. He said more schools need to take such steps.

On Friday, Obama said higher education has become an imperative for success in America, but the cost has grown unrealistic for too many families and the debt burden unbearable. He said states should also properly fund colleges and universities.

"We are putting colleges on notice," Obama told an arena packed with cheering students. "You can't assume that you'll just jack up tuition every single year. If you can't stop tuition from going up, then the funding you get from taxpayers each year will go down."

Obama is targeting only a small part of the financial aid picture ? the $3 billion known as campus-based aid that flows through college administrators to students. He is proposing to increase that amount to $10 billion and change how it is distributed to reward schools that hold down costs and ensure that more poor students complete their education.

The bulk of the more than $140 billion in federal grants and loans goes directly to students and would not be affected.

The average in-state tuition and fees at four-year public colleges this school year rose 8.3 percent and with room and board now exceed $17,000 a year, according to the College Board.

Rising tuition costs have been attributed to a variety of factors, among them a decline in state dollars and competition for the best facilities and professors. Critics say some higher education institutions are attempting to wait out the economic downturn and have been too reluctant to make large-scale changes that would cut costs such as offering three-year degree programs.
Washington's leverage to take on the rising cost of college is limited because American higher education is decentralized, with most student aid following the student.
The response to Obama's plan wasn't all negative. Many university presidents said they welcome a conversation about making college more affordable and efficient.
In Missouri, where Gov. Jay Nixon has proposed a 12.5 percent funding cut for higher education in the coming fiscal year, Obama's proposal could put even more pressure on public colleges and universities to limit tuition increases. By state law, schools must limit such increases to the annual inflation rate unless they receive permission for larger hikes. Nixon has warned schools that he doesn't want to see a tuition increase of more than 3 percent, the latest Consumer Price Index increase.
"The president's message isn't inconsistent with the agenda that we've been pursuing here in Missouri," said Paul Wagner, deputy commissioner of the state Department of Higher Education. "It's good to see him put the focus on the same things."
Obama also wants to create a "Race to the Top" competition in higher education similar to the one his administration used on lower grades. He wants to encourage states to make better use of higher education dollars in exchange for $1 billion in prize money.
Obama is also pushing for more tools to help students determine which colleges and universities have the best value.

North America boosts Ford in 4Q

DEARBORN, Mich. (AP) ? Ford has shown it can make money even with U.S. car sales at depressed levels. Now it needs to show it can manage a myriad of challenges outside its home region.
North America was the only region where Ford Motor Co. saw profits rise in the fourth quarter and in all of 2011. Everywhere else the automaker lost money or saw profits fall, hurt by nervous consumers in Europe, flooding in Asia and aging products in South America. Costs rose faster than expected, too.
Ford reported $13.62 billion in net income, but investors brushed off the result because most of that came from an accounting change. Excluding that change, earnings totaled $1.1 billion, or 20 cents a share, down 15 percent from the fourth quarter of 2010. Ford missed Wall Street's expectations by 5 cents.
The stock price took an early hit but recovered once the company promised better ? if still bumpy ? results in 2012. Shares fell 4 percent to close at $12.21.
Chief Financial Officer Lewis Booth said the Thai flooding and the rising cost of steel and other commodities hurt Ford more than analysts expected.
The November floods, which affected Thai parts suppliers, cost 34,000 units of production in Thailand and in South Africa, which relies on Thai-made parts. Ford also spent $2.3 billion more on commodities in 2011 than the prior year, or $100 million more than it forecast.
Bill Selesky, an auto analyst with Argus Research, said investors relaxed after Ford explained its accounting change and reassured them that it expects operating margin to increase this year.
Ford's operating margin ? a measure of how much the company earned after all the costs of doing business ? fell to 2.2 percent from 3 percent in 2010, largely because of commodity costs.
"The company said, 'Listen, we can manage through this, and North America is very, very strong,'" Selesky said.
North American operating profits rose 33 percent to $889 million in the fourth quarter. For the full year, North American profits rose 15 percent to $6.2 billion.
Ford's U.S. market share was up for the year, and the company got higher prices for new vehicles like the Ford Explorer and Ford Focus. U.S. buyers paid an average of $29,524 for Ford cars and trucks last year, up 6 percent from 2009, according to automotive pricing site TrueCar.com.
But in Europe, Ford's second-most important region by sales, fourth-quarter operating losses more than doubled to $190 million and sales fell 1 percent.
Booth said the company isn't sure how much impact the debt crisis will have on European sales this year. But CEO Alan Mulally said he's optimistic, since Ford has 10 new or revamped vehicles going on sale in the region. In the meantime, Ford is cutting European production by 36,000 vehicles in the first quarter.
Rival General Motors Co. is also expected to be hurt by weak results in Europe. It reports quarterly results Feb. 16. Chrysler Group, which has little international exposure, will be buoyed by its U.S. sales when it releases earnings Feb. 1.
In Asia, Ford's sales fell 7 percent in the fourth quarter, largely because sales in China have slowed. Ford's Asia Pacific region lost $83 million in the quarter after posting a profit in 2010.
Booth said things will be bumpy in Asia for the next several years as Ford embarks on a major expansion that includes the construction of seven plants. The company aims to triple the cars in its Chinese lineup to 15 over the next three years.
The South American market was another disappointment. Both sales and market share fell. Booth said South America is getting more competitive, and Ford's products there are older than other brands. Ford aims to turn that around when it introduces new products there next year.
For the full year, the Dearborn-based company reported net income of $20.2 billion, or $4.94 per share.
Ford's accounting change resulted in big gains on paper. The move dates to 2006, when Ford moved $15.7 billion worth of tax credits and other assets off its books because it wasn't making money so it couldn't take advantage of them. Now that it's profitable, the company moved most of those assets back onto its books.
The change will affect Ford's tax rates going forward. Ford's tax rate was 9 percent in 2010 because of the assets that were being held under the valuation allowance. Ford's new rate will be closer to 30 percent.
Booth called the change a "significant milestone" and said it's a strong indication that the company expects to stay profitable. Another is Ford's decision last month to reinstate a 5-cent quarterly dividend starting in March.
Without the big accounting gain, Ford earned $8.76 billion, or $1.51 per share, its highest operating profit since 1999. Revenue rose 13 percent to $136.3 billion. Analysts had forecast full-year earnings of $1.86 per share on revenue of $127.31 billion.
Based on its full-year North American results, Ford will make profit-sharing payments of around $6,200 each to its 41,600 U.S. hourly employees. Employees will get their checks in March.
Ford also said Friday that it plans to contribute $3.5 billion to its global pension funds this year. Underfunded pensions have been another area of concern for investors and for ratings agencies, which recently raised Ford's credit rating to one notch below investment grade. Ford has been below investment grade since 2005.
Standard and Poor's analyst Efraim Levy, who maintains a "buy" rating on Ford shares, said he wasn't concerned that Ford missed analysts' expectations.
"I don't think they have to fully meet their goals to be successful," he said. "Directionally, they are moving where they have to be."
But Levy said Ford will have to watch its back in the U.S., where Toyota and Honda are finally recovering from earthquake-related shortages and smaller players like Volkswagen and Kia are making inroads.
"I tend to give Ford the benefit of the doubt, but I do think the easy gains are over for them," he said.

(Reuters) ? Symantec Corp, the top maker of computer security software, reported a higher quarterly profit and issued an outlook in line with Wall Street estimates.

The company reported profit, excluding items, of 42 cents per share for its fiscal third quarter, ended Dec 30, beating the average analyst forecast of 41 cents, according to Thomson Reuters I/B/E/S.

The Mountain View, California-based software maker also forecast fourth-quarter per-share profit, excluding items, of 41 or 42 cents, below the average analyst forecast of 43 cents.

Symantec shares were quoted at $17.04 in extended trade, down from their Nasdaq close of $17.07.

Rap music powers rhythmic action of medical sensor

ScienceDaily (Jan. 26, 2012) ? The driving bass rhythm of rap music can be harnessed to power a new type of miniature medical sensor designed to be implanted in the body.

Acoustic waves from music, particularly rap, were found to effectively recharge the pressure sensor. Such a device might ultimately help to treat people stricken with aneurisms or incontinence due to paralysis.

The heart of the sensor is a vibrating cantilever, a thin beam attached at one end like a miniature diving board. Music within a certain range of frequencies, from 200-500 hertz, causes the cantilever to vibrate, generating electricity and storing a charge in a capacitor, said Babak Ziaie, a Purdue University professor of electrical and computer engineering and biomedical engineering.

"The music reaches the correct frequency only at certain times, for example, when there is a strong bass component," he said. "The acoustic energy from the music can pass through body tissue, causing the cantilever to vibrate."

When the frequency falls outside of the proper range, the cantilever stops vibrating, automatically sending the electrical charge to the sensor, which takes a pressure reading and transmits data as radio signals. Because the frequency is continually changing according to the rhythm of a musical composition, the sensor can be induced to repeatedly alternate intervals of storing charge and transmitting data.

"You would only need to do this for a couple of minutes every hour or so to monitor either blood pressure or pressure of urine in the bladder," Ziaie said. "It doesn't take long to do the measurement."

Findings are detailed in a paper to be presented during the IEEE MEMS conference, which will be Jan. 29 to Feb. 2 in Paris. The paper was written by doctoral student Albert Kim, research scientist Teimour Maleki and Ziaie.

"This paper demonstrates the feasibility of the concept," he said.

The device is an example of a microelectromechanical system, or MEMS, and was created in the Birck Nanotechnology Center at the university's Discovery Park. The cantilever beam is made from a ceramic material called lead zirconate titanate, or PZT, which is piezoelectric, meaning it generates electricity when compressed. The sensor is about 2 centimeters long. Researchers tested the device in a water-filled balloon.

A receiver that picks up the data from the sensor could be placed several inches from the patient. Playing tones within a certain frequency range also can be used instead of music.

"But a plain tone is a very annoying sound," Ziaie said. "We thought it would be novel and also more aesthetically pleasing to use music."

Researchers experimented with four types of music: rap, blues, jazz and rock.

"Rap is the best because it contains a lot of low frequency sound, notably the bass," Ziaie said.

The sensor is capable of monitoring pressure in the urinary bladder and in the sack of a blood vessel damaged by an aneurism. Such a technology could be used in a system for treating incontinence in people with paralysis by checking bladder pressure and stimulating the spinal cord to close the sphincter that controls urine flow from the bladder. More immediately, it could be used to diagnose incontinence. The conventional diagnostic method now is to insert a probe with a catheter, which must be in place for several hours while the patient remains at the hospital.

"A wireless implantable device could be inserted and left in place, allowing the patient to go home while the pressure is monitored," Ziaie said.

The new technology offers potential benefits over conventional implantable devices, which either use batteries or receive power through a property called inductance, which uses coils on the device and an external transmitter. Both approaches have downsides. Batteries have to be replaced periodically, and data are difficult to retrieve from devices that use inductance; coils on the implanted device and an external receiver must be lined up precisely, and they can only be about a centimeter apart.

A patent application has been filed for the design.

TORONTO (Reuters) ? Shares of Research In Motion rose 8.6 percent on Wednesday, rebounding after two days of declines on disappointment over the choice of an company insider as the BlackBerry maker's new chief executive.

The jump followed a 8 percent swoon on Monday and a 3.5 percent drop on Tuesday. Over the weekend, RIM replaced co-chief executives Mike Lazaridis and Jim Balsillie with Thorsten Heins, a four-year veteran of the struggling company.

RIM's rise also came a day after Apple posted blockbuster quarterly results highlighting the strong global market for smartphones.

A report in a technology blog that said RIM's next-generation BlackBerry 10 smartphones were on track for a September launch may have also given a lift to the stock, said Todd Coupland from CIBC Capital Markets.

"The market might have been reacting to some blog reports that the first BB 10 products may be coming sooner than expected," he said.

Even so, Coupland was skeptical about the posting in the Boy Genius Report, which did not specify a source.

In December, RIM delayed the phones using the same software in its PlayBook tablet until the latter part of 2012.

The blog earlier this month said RIM was in talks to sell itself to Samsung, triggering a 10 percent spike in the shares.

Samsung later denied any interest in acquiring RIM, and a source close to the BlackBerry maker said the two companies had never been in buyout talks.

RIM's Nasdaq-listed shares closed at $16.30 and its Toronto stock was at C$16.40. The stock has fallen 75 percent in the past year.

Reporters can now bring gadgets to House chamber

Tuesday's State of the Union address will be the first time reporters will be able to bring their electronic devices into the House gallery, according to a post in Roll Call. Photography and video won't be allowed, but if all goes well, electronic reporting will be permitted going forward.
There are, of course, a number of concerns: Reporters can't make calls, and phones must be completely silent ??even vibrate mode is prohibited. And reporters will be "closely monitored" to ensure there are no egregious (and potentially embarrassing) infractions.

The experiment will continue after the State of the Union. The House of Representatives will allow reporters to bring gadgets for the duration of the current session of Congress, and will evaluate whether or not to continue after that.?

CLAREMORE, Okla. ? An Oklahoma hospital in Garth Brooks' hometown must pay $1 million to the country singer because it failed to build a women's health center in honor of his late mother, jurors ruled Tuesday evening.

Jurors ruled that the hospital must return a $500,000 donation to Brooks plus pay him $500,000 in punitive damages in Brooks' breach-of-contract lawsuit against IntegrisCanadian Valley Regional Hospital in Yukon. Brooks said he thought he'd reached a deal in 2005 with the hospital's president, James Moore, but sued after learning the hospital wanted to use the money for other construction projects.

The hospital argued that Brooks gave it unrestricted access to the $500,000 donation and only later asked that it build a women's center and name it after his mother, Colleen Brooks, who died of cancer in 1999.

"Obviously we are disappointed, particularly with the jury's decision to award damages above and beyond the $500,000," Integris spokesman Hardy Watkins said. "We're just glad to see the case come to a resolution."

Brooks called the jurors "heroes" and said he felt vindicated by their verdict.

"I no longer feel like I'm crazy," he said.

Jury member Beverly Lacy said she voted in favor of Brooks because she thought the hospital went back on its word. As far as the punitive damages, she said: "We wanted to show them not to do that anymore to anyone else."

During the trial, Brooks testified that he thought he had a solid agreement with Moore. Brooks said the hospital president initially suggested putting his mother's name on an intensive care unit, and when Brooks said that wouldn't fit her image, Moore suggested a women's center.

"I jumped all over it," Brooks told jurors in tearful testimony. "It's my mom. My mom was pregnant as a teenager. She had a rough start. She wanted to help every kid out there."

His attorney told the jury during closing arguments that Brooks kept his end of the agreement.

"This case is about promises: promises made and promises broken," lawyer John Hickey told jurors shortly before they started deliberating. "Mr. Brooks kept his promise. Integris never intended to keep their promise and never built a new women's center."

But hospital attorney Terry Thomas said Brooks' gift initially came in anonymously and unrestricted in 2005. He also noted that Brooks couldn't remember key details of negotiations with the hospital's president ? including what he'd been promised ? when questioned during a deposition after filing his lawsuit in 2009.

"At most, it was a misunderstanding between these two," Thomas told jurors during his closing argument. "Am I calling Mr. Brooks a liar? Absolutely not. It's perfectly understandable that he does not remember these events."

The jury began deliberating Tuesday afternoon in Rogers County District Court, and the judge told jurors she wanted them to work as late as midnight to come to a decision.

Before the verdict was read, Brooks said the day had been emotional. The country music star said he was simply trying to honor his mother.

"This little pistol, she deserves nothing but good," Brooks said.

The blind Mexican cavefish (Astyanax mexicanus) have not only lost their sight but have adapted to perpetual darkness by also losing their pigment (albinism) and having altered sleep patterns. New research published in BioMed Central's open access journal BMC Evolutionary Biology shows that the cavefish are an example of convergent evolution, with several populations repeatedly, and independently, losing their sight and pigmentation.

The blind cavefish and the surface dwelling Mexican tetra, despite appearances, are the same species and can interbreed. The cavefish are simply a variant of the Mexican tetra, albeit one adapted to living in complete darkness. A team of researchers from Portugal, America, and Mexico studied the DNA from 11 populations of cavefish (from three geographic regions) and 10 populations of their surface dwelling cousins to help understand the evolutionary origin of the physical differences between them.

While results from the genotyping showed that the surface populations were genetically very similar, the story for the cave populations was very different. The cave forms had a much lower genetic diversity, probably as a result of limited space and food. Not surprisingly the cave populations with the most influx from the surface had the highest diversity. In fact there seemed to be a great deal of migration in both directions.

It has been thought that historically at least two groups of fish lived in the rivers of Sierra de El Abra, Mexico. One group originally colonized the caves, but became extinct on the surface. A different population then restocked the rivers and also invaded the caves.

Prof Richard Borowsky, from the Cave Biology Group at New York University explained, "We were fortunate in being able to use A. mexicanus as a kind of 'natural' experiment where nature has already provided the crosses and isolation events between populations for us. Our genotyping results have provided evidence that the cave variant had at least five separate evolutionary origins from these two ancestral stocks."

Dr Martina Bradic who lead the research continued, "Despite interbreeding and gene flow from the surface populations the eyeless 'cave phenotype' has been maintained in the caves. This indicates that there must be strong selection pressure against eyes in the cave environment. Whatever the advantage of the eyeless condition, it may explain why different populations of A. mexicanus cave fish have independently evolved the same eyeless condition, a striking example of convergent evolution."

Citizen Kane Screens Inside Hearst Castle

When the film "Citizen Kane" came out in 1941, William Randolph Hearst gave it an unequivocal two thumbs down.
The press lord kept ads for the film out of his many newspapers. Just before its release, one of his allies in Hollywood tried to buy the footage in order to burn it. Another approached FBI chief J. Edgar Hoover, who launched a decade-long investigation of Orson Welles, the film's 26-year-old director, producer, co-writer and star.
But rosebuds bloom in unlikely places. Seventy-one years after Hearst's effort to derail it, "Citizen Kane" will be shown at Hearst Castle's visitors center, with the blessings of the Hearst family.
The March 9 screening on the five-story-tall screen at the Hearst Castle Theater is part of the San Luis Obispo International Film Festival.
Wendy Eidson, the festival's director, said the film probably has never been seen on Hearst's sprawling estate. Since 1958, the opulent landmark, which Hearst called "La Cuesta Encantada" (The Enchanted Hill), has been open to the public as a state park.
"I tossed out the idea of screening 'Citizen Kane' there as a joke, and they didn't laugh," Eidson said. "I was sort of floored."
Steve Hearst, the mogul's great-grandson, said the event will present the film as a work of fiction rather than as a documentary about the life of the patriarch known to family members as W.R.
"It's a great opportunity to draw a clear distinction between W.R. and Orson Welles, between the medieval, gloomy-looking castle shown in 'Citizen Kane' and the light, beautiful, architecturally superior reality," he said.
"Citizen Kane" is the unflattering portrait of a character resembling Hearst, a sensationalistic newspaper tycoon with political ambitions, a young mistress in show business, a jaw-dropping mansion and an insatiable zeal for collecting art.
The parallels between Hearst and Charles Foster Kane are obvious ? but so, too, are the differences, said Steve Hearst, who manages the family's ranches and other business interests.
"The character Orson Welles depicted was quite a bit more flamboyant and outgoing than W.R. was," he said. "He wasn't the kind of guy who would be dancing in the editorial room with his staffers."
Another big difference was in the film's portrayal of Kane's love interest, a booze-soaked singer forced by Kane into a disastrous operatic career. Hearst's real-life mistress, Marion Davies, was a talented comic actress later described by Welles as "an extraordinary woman ? nothing like the character."
By all accounts, Hearst was angry over her portrayal. Decades later, Welles agreed: "I always thought he was right to be upset about that," he said in a 1969 interview with director Peter Bogdanovich.
In the film, Charles Foster Kane dies alone in his castle, a pathetic old man. His final word is the enigmatic "Rosebud" ? the name, as it turned out, of the sled Kane had kept from his childhood.
When Hearst died in 1951, he was surrounded by family at the Beverly Hills mansion he shared with Davies.
"His last words went unrecorded," said film scholar James Naremore.
Though Hearst knew enough about "Citizen Kane" to dislike it immensely, he never actually saw the film, according to Davies and others.
Welles even liked to tell a story about the tycoon declining a personal invitation to see it. In the 1969 interview, he said he bumped into Hearst in an elevator at the Fairmont Hotel the night the film opened in San Francisco.
"He and my father had been chums, so I introduced myself and asked if he'd like to come to the opening of the picture," Welles recalled.
The reception was chilly.
"He didn't answer," said Welles, who, ever the showman, took full advantage of the moment:
"As he was getting off at his floor, I said, "Charles Foster Kane would have accepted.' "

Spurs visit vulnerable City as title race heats up

LONDON (AP) -Loaned out by Manchester City for the past 12 months, Emmanuel Adebayor will be denied the chance to show what the Premier League leaders are missing when his new club Tottenham visits the Etihad Stadium for a key match in the title race on Sunday.
The restrictions of Adebayor's season-long loan move to Spurs prevent him from facing City, robbing them of their attacking spearhead for arguably their biggest game of the season.
The Togo striker has become a crowd favorite at White Hart Lane, scoring a team-high nine league goals to justify Harry Redknapp's controversial decision to bring in a player who turned out for the team's fierce rival Arsenal from 2006-09.
His situation at City couldn't have been more different, dropping down the pecking order soon after his 25 million pounds move from Arsenal and quickly out of favor with manager Roberto Mancini. He was farmed out to Real Madrid for the second half of last season.
"Sometimes it's possible that you have a situation like this - you have good players but he wants to play always and this is difficult in a top team," Mancini said. "If you have one striker who needs to play always it is not easy.
"I am happy for Manu because he is playing very well for Tottenham."
City has key players missing themselves as the team looks to extend its perfect home record to 11 league matches.
Captain Vincent Kompany serves the third match of his four-game suspension and key midfielder Yaya Toure is at the African Cup of Nations with Ivory Coast, along with his brother and fellow City player Kolo.
Striker Mario Balotelli and right back Micah Richards return from injury but City has been lacking the class and verve that saw them take the league by storm in the first few months of the season, including a 5-1 win at Spurs in August.
Once a match between two perennial underachievers in the English game - neither side has won the league since the 1960s - City-Tottenham has suddenly taken on a much bigger profile.
"They are not invincible," Redknapp said. "I think we can win. We will go there as a positive team. I wouldn't want to go there and sit back.
"We have people who can hurt them."
In what is the most crucial weekend in the title race so far, second-place Manchester United will also look to keep the pressure on City when it travels to fifth-place Arsenal on Sunday.
United is three points behind its neighbor as the team bids to extend its record haul of titles to 20 but for Arsenal, qualification for the Champions League is the priority this season.
Arsene Wenger's team could drop seven points off the top four if it loses to United and fourth-place Chelsea wins at Norwich on Saturday.
"I still think that when we have everybody available we are a strong force in this league," Wenger said. "That's why it is important that we fight very hard not to drop points."
Arsenal, though, has lost its last two matches - to Fulham and Swansea - and is still without a fit full back, although central defender Thomas Vermaelen could return from a calf injury. Thierry Henry, hoping to feature in his third match since joining on a two-month loan for a second spell at Arsenal, will have a fitness test on a calf injury.
United, which thrashed Arsenal 8-2 at Old Trafford in the first match between the teams this season, is set to welcome back England defenders Chris Smalling and Phil Jones from minor injuries.
The rest of the matches come on Saturday, when defender Gary Cahill could make his debut for Chelsea at Carrow Road following his move from Bolton.
Sixth-place Newcastle visits Fulham and Liverpool travels to next-to-last Bolton.
Mark Hughes takes charge of his first home league match at third-bottom Queens Park Rangers when Wigan visits in a key match in the relegation battle.
Also Saturday, it's Everton vs. Blackburn, Stoke City vs. West Bromwich Albion, Sunderland vs. Swansea and Wolverhampton Wanderers vs. Aston Villa.

Rap group 2 Live Crew to reunite, tour this summer

PARK CITY, Utah (AP) ? The rap group that inspired controversy in the early 1990s with songs like "Me So Horny" is reuniting and hitting the road.
Luther Campbell says 2 Live Crew is back together and will tour this summer.
The rapper and producer made the announcement Saturday at the Sundance Film Festival, where he is promoting his appearance in the short film "The Life and Freaky Times of Uncle Luke."
Campbell describes the film as "an art piece" that he did to help young filmmakers who were inspired by his hip-hop work.
Campbell says he "just can't wait to just start practicing" with his old crew. But don't expect them to be "As Nasty As They Wanna Be."
Campbell says the group will "perform the songs and everybody's going to be excited."

20 homes burn as high winds fuel blaze near Reno

A raging wildfire burning near Reno, Nev., has forced thousands of people from their homes and is blamed for at least one death. NBC's Miguel Almaguer reports.

Updated at 5:12 a.m. ET: Firefighters worked early Friday to hold the line on a fast-moving brush fire that tore through the Reno area, destroying more than 20 homes and forcing thousands of residents to flee.
The blaze started shortly after noon Thursday and, fueled by wind gusts reaching 82 mph, mushroomed to more than 6 square miles in size before firefighters stopped its surge toward Reno.

About 2,000?people remained under evacuation orders late Thursday, Reno Fire Chief Michael Hernandez said. About 250 firefighters were battling the blaze.
Wet weather was forecast Friday, and snow was forecast Friday night. But high winds were expected to continue, with gusts up to 40 mph.

About 2,300 homes in the area were without power Thursday night.
Updated 1:10 a.m. ET: More than 10,000 people have been evacuated as a wind-driven wildfire burns out of control near Reno, The Associated Press reports. Reno Fire Chief Michael Hernandez said hundreds of firefighters were "in the thick of battle" against a blaze that has burned across thousands of acres.
"The news is not good," Hernandez said. Wind gusts of up to 82 mph were reported and a five-mile stretch of U.S. Highway 395 was closed.
Hernandez confirmed one death, but would not say it was caused by the fire until an autopsy is performed, KRNV.com reported.
Gov. Brian Sandoval has declared a state of emergency.

At a press conference Thursday afternoon, fire officials said that?the brush fire began around noon just north of Washoe Lake and that the cause was under investigation.

Sheriff's deputies told the?Reno newspaper?winds?were pushing flames closer to Reno, where voluntary evacuations were issued in several neighborhoods.
Vice President Joe Biden's visit to Reno -- already delayed because of bad weather?-- was cut short because of the fire.?Biden was two hours late to give a speech to students?at Galena High School. The vice president was forced to end his speech?after 25 minutes because officials needed the high school gym as a command center for firefighters.

Winds in the area were gusting over?50 mph, The Weather Channel reported, but were expected to moderate on Friday to about 20 mph, with gusts to about 30 mph.
Winds gusts?up to 82 mph were reported within a few miles of the fire, and a gust of 122 mph was recorded atop Slide Mountain, which is between the fire and Reno at the Mount Rose ski resort.
Rounding up horses
Flames up to 40 feet high raced through sagebrush, grass and pines in an area where small neighborhoods are dispersed in a rural landscape. Washoe County animal services officials were helping round up horses and other livestock for evacuation.
